Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, subscriptions, and alert services (the "Services") provided by Beacon CRE LLC ("Beacon," "we," "us"). By creating an account, subscribing, or opting in to our alerts, you agree to these Terms. If you do not agree, do not use the Services.

1The Services

Beacon CRE Wire aggregates and delivers commercial real estate transaction information for the New England market, including a same-day "Pro Feed" delivered by email and SMS text message. The Services are provided for your internal business and informational use.

2Eligibility & accounts

You must be at least 18 years old and using the Services for business purposes. You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your account credentials and all activity under your account.

3Subscriptions, billing & cancellation

• Paid subscriptions (including the Pro Feed) are billed in advance on a recurring basis through our payment processor, Stripe.
• Unless cancelled, subscriptions automatically renew at the then-current rate for each billing period.
• You may cancel at any time; cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable.
• We may change pricing prospectively with reasonable notice.

5Acceptable use

You agree not to: (a) resell, redistribute, republish, or sublicense the Services or their data without our written permission; (b) scrape, copy, or create derivative databases from the Services; (c) share your account or alerts with non-subscribers; or (d) use the Services unlawfully or to infringe others' rights.

6Intellectual property

The Services, including our compilation, enrichment, and delivery of deal data, and all related software, text, and design, are owned by Beacon and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your own business use during your subscription. All rights not expressly granted are reserved.

7Data accuracy — important disclaimer

Deal information is compiled from public records and other sources and is provided "as is" for informational purposes only. While we work to deliver timely, accurate data, we do not warrant that any listing, price, party name, date, or other detail is complete, current, or error-free. You should independently verify any information before relying on it, and the Services are not a substitute for professional, legal, financial, or title advice.

8Third-party services

The Services rely on third-party providers (e.g., hosting, payment, email, and SMS providers) and may link to third-party sites. We are not responsible for third-party services or content.

9Disclaimer of warranties

The services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, timely, secure, or error-free.

10Limitation of liability

To the fullest extent permitted by law, Beacon will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business, arising from or related to the services. Our total liability for any claim will not exceed the amount you paid us for the services in the twelve months before the claim.

11Indemnification

You agree to indemnify and hold Beacon harmless from claims, losses, and expenses arising out of your use of the Services or violation of these Terms.

12Termination

We may suspend or terminate your access at any time for violation of these Terms or to protect the Services. You may stop using the Services at any time. Sections that by their nature should survive (including IP, disclaimers, and limitation of liability) will survive termination.

13Governing law & disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Massachusetts for any dispute not subject to other agreed resolution.

14Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date; continued use after changes means you accept them.
